1. Acceptance of these terms

These Terms of Use ("Terms") govern your access to and use of activewaterlabs.com (the "Site"), operated by ActiveWater Labs, LLC ("ActiveWater Labs," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

2. Who we are

ActiveWater Labs, LLC is a United States water-technology company. We design and build precision dosing systems for filtered water, including our flagship product, MineralDose™. You can reach us at hello@activewaterlabs.com.

3. Use of the site

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, informational, and internal business purposes. This license does not include any right to reproduce, distribute, modify, or create derivative works from the Site's content except as permitted by these Terms or applicable law (such as fair use, including customary press quotation with attribution).

4. Intellectual property

The Site and all of its content — text, graphics, logos, illustrations, page designs, and code — are owned by ActiveWater Labs, LLC or its licensors and are protected by copyright, trademark, and other intellectual-property laws.

ActiveWater Labs™ and MineralDose™ are trademarks of ActiveWater Labs, LLC. Certain technology described on this Site is the subject of pending patent applications. Nothing on the Site grants you any license or right to use any trademark, patent, or other intellectual property of ActiveWater Labs without our prior written permission, except that journalists may use our names and marks accurately to refer to us, consistent with the guidance in our newsroom.

5. Acceptable use

You agree not to:

  • use the Site in any way that violates applicable law or regulation;
  • attempt to gain unauthorized access to the Site, its hosting infrastructure, or any connected systems;
  • interfere with the Site's operation, including by transmitting malware, flooding, scraping at disruptive volume, or circumventing security measures;
  • misrepresent your affiliation with ActiveWater Labs, or use our marks in a way likely to cause confusion;
  • frame or mirror the Site in a manner that misattributes its content.

If you believe you've found a security vulnerability, please report it responsibly to hello@activewaterlabs.com (subject "Security report"). We appreciate good-faith research and will not pursue claims against researchers who act in good faith, avoid privacy violations and service disruption, and give us reasonable time to remediate.

6. Product information; forward-looking statements

The Site describes products and technology that are in development. Specifications, features, imagery, pricing indications, and availability dates are engineering targets, not commitments, and may change or be discontinued at any time without notice. Content on the Site is provided for general information only; it is not an offer to sell, a warranty, or professional advice of any kind. MineralDose™ products are designed to complement a reverse-osmosis system; they are not water filters or purifiers and are not a substitute for one.

7. Purchases & crowdfunding campaigns

The Site does not sell anything directly. Waitlist signups, crowdfunding pledges, and future purchases occur on other platforms — such as mineraldose.com and Kickstarter — under those platforms' and products' own terms, policies, and disclosures. Those terms, not these, govern any pledge or purchase you make there.

8. Third-party sites

The Site links to third-party websites and services (including mineraldose.com, Kickstarter, and social platforms). We don't control them and are not responsible for their content, policies, or practices. A link is not an endorsement. Your use of third-party sites is at your own risk and subject to their terms.

9. Unsolicited ideas

We love hearing from people, but if you send us unsolicited ideas, suggestions, or materials (other than job applications or vulnerability reports), you agree that we may use them without restriction or compensation, and that your submission does not create any confidential relationship. Please don't send us anything you consider proprietary.

10. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. YOUR USE OF THE SITE IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ACTIVEWATER LABS, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify and hold harmless ActiveWater Labs, LLC and its members, officers, employees, and agents from and against claims, damages, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.

13. Governing law

These Terms are governed by the laws of the United States and the State in which ActiveWater Labs, LLC is organized, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Site that cannot be resolved informally shall be brought exclusively in the state or federal courts located in that State, and you consent to their jurisdiction. Nothing in this section limits any non-waivable consumer-protection rights you hold under the laws of your place of residence.

14. Changes to these terms

We may revise these Terms from time to time. The current version, with its effective date, will always be posted at this address; material changes will be flagged on this page. Your continued use of the Site after a revision takes effect constitutes acceptance of the revised Terms.

15. General provisions

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site.
  • Severability. If any provision is held unenforceable, the remainder stays in effect, and the unenforceable provision is modified to the minimum extent necessary.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
